Terms of Service

Version 2026-08-01 We record which version each customer accepted.

Draft pending legal review. This document is a working draft prepared during development. It must be reviewed and approved by qualified counsel in the operating entity's jurisdiction before launch, as required by our own release checklist. Do not rely on it as a binding agreement in its present form.

1. Who these terms are between

These terms are an agreement between you and TrackingTop ("we", "us"). By creating an account or using the service, you accept them. We record which version you accepted and when.

If you are accepting on behalf of a company, you confirm you are authorised to bind that company.

2. What the service does

We provide access to carrier tracking records obtained from approved sources, together with a dashboard, an API and related tooling.

Production records are obtained only from: a carrier or shipping-platform API; a contracted tracking-data provider whose agreement permits this use; a carrier account you have connected and whose ownership you have demonstrated; or an audited imported inventory with recorded provenance.

We do not generate tracking numbers algorithmically for production use. Our sandbox environment produces clearly labelled test values prefixed TEST, which have no validity anywhere and must not be presented as real.

3. What we do and do not warrant

We warrant that each production record was obtained from an approved source as described above, and that the source, destination match, last observed status and eligibility we display for a record reflect what we hold at the time of assignment.

We do not warrant that a record corresponds to any particular physical shipment, unless it was drawn from your own connected carrier account. We do not warrant that any marketplace, platform or third party will accept, honour or act upon a record. We do not warrant that carrier status information is current, complete or real-time; we show when a status was observed so you can assess it yourself.

Except as expressly stated, the service is provided "as is".

4. Acceptable use

Your use of the service is governed by our Acceptable Use Policy, which forms part of these terms. In summary, you must not use the service to defraud any person, to misrepresent a shipment to a buyer or platform, to evade a platform's verification or enforcement, or to abuse our systems.

We may suspend or terminate an account that breaches that policy, and we may do so without notice where the breach is serious or ongoing.

5. Your account

You are responsible for the security of your account credentials and API keys, and for all activity under them. Enable two-factor authentication. Tell us promptly if you believe an account or key has been compromised; you can revoke a key yourself at any time.

You must provide accurate registration information, including your country, which determines tax treatment and eligibility.

6. Restricted regions

We do not offer the service in certain countries, based on applicable sanctions, our providers' terms, and our own risk assessment. We check this at registration, at sign-in, at checkout and on API use. The current list is maintained in our systems and available on request.

You must not use the service from, or on behalf of any person in, a restricted region, and you must not attempt to circumvent this check.

7. Balance, pricing and payment

The service is pay-as-you-go. There is no subscription. You hold an account balance denominated in US dollars and spend it on tracking records.

Topping up. The minimum deposit is $1.00. Deposits are made in USDT on BNB Smart Chain (BEP20) to the address we display. Your balance is credited only when we have verified the transaction on-chain and approved it; submitting a transaction hash does not itself credit anything. You are responsible for sending the correct asset on the correct network — funds sent as another token, or on another chain, cannot be recovered by us.

Pricing. Lifetime records are priced per record at the published volume rate for the size of your order, applied as a flat rate across the whole order. Packages are a fixed quantity at a fixed price, valid for the stated period.

What expires. Your balance does not expire. Records you have bought do not expire. Only unclaimed package quantity expires, at the end of the package's validity period.

Charging. You are charged only for records actually claimed for you. Where fewer records match your criteria than you requested, you receive and pay for the number actually claimed. There are no overage charges: an order exceeding your balance is declined before anything is charged.

Referral commission. Where we operate a referral programme, commission is credited as account balance, is subject to the conditions published on the referral page, and may be withheld or voided where we identify abuse.

8. Refunds

Refunds are governed by our Refund Policy. In summary, credited balance is non-refundable because it is immediately spendable, and we correct our own errors.

9. Availability and changes

We aim to keep the service available but do not guarantee uninterrupted operation. We may modify, suspend or discontinue features. Where a change materially reduces what you have paid for, we will tell you in advance and, if you prefer, refund the unused portion of your current period.

API versions are additive within a major version; a breaking change requires a new version and a sunset notice.

10. Intellectual property and third-party marks

We retain all rights in the service, its software and its content. Carrier and marketplace names and logos are the trademarks of their respective owners; we use them descriptively and claim no affiliation, endorsement or partnership. See our Trademark Notice.

11. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Subject to that, our total liability to you in any twelve-month period is limited to the amount you paid us in that period. We are not liable for indirect or consequential loss, loss of profit, loss of goodwill, or losses arising from a third party's decision about how to treat a record — including any marketplace action against your seller account.

12. Indemnity

You will indemnify us against claims arising from your use of the service in breach of these terms or the Acceptable Use Policy, including claims by buyers, platforms or regulators.

13. Changes to these terms

We may update these terms. Each version is published with a version identifier, and we record which version each customer accepted. Where a change is material, we will notify you and ask you to accept the new version before continuing to use the service.

14. Governing law

To be completed on legal review, together with the operating entity's name, registered address and dispute-resolution forum.
